NOVE MIGRACIJSKE PRILIKE U EVROPSKOJ UNIJI I LIBERALIZACIJA TRGOVINE USLUGAMA

SAŽETAK

Cilj ovog naučnog rada je ilustracija stanja u Evropskoj Uniji po pitanju novih migracijskih prilika i liberalizacije trgovine uslugama. Kako vremenom pružanje usluga sve više predstavlja osnovnu polugu za ekonomski doprinos odnosno razvoj, za razliku od doba kada je manufaktura predstavljala tu osnovu, analiza stanja migracijskih prilika uzrokovanih liberalizacijom trgovine uslugama u Evropskoj Uniji je logičan izbor za ilustrovanje realnog stanja predmetne problematike. Kroz rad će se konkretnim primjerima, slučajevima iz prakse Evropskog Suda pravde, ukazati na pozitivne i negativne momente u radu odnosno praski Suda. Analiza je rađena rukovodeći se prevashodno pravnim parametrima koji definišu područje interesovana, zatim ekonomskim, političkim et cetera. Rezultati/zaključci su dobiveni korištenjem analitičkih, deduktivnih, opservatnih, histroijskih i komparativnih metoda. U konačnici, doprinos većem stepenu integracije u Evropskoj Uniji, pa samim tim i u Bosni i Hercegovini, kao i boljim odnosno liberalnijim uslovima za rad/pružanje usluga su ultimativni motiv stavaranja ovog djela. Navedeni podaci će biti izloženi kroz pet osnovnih poglavlja: ‘Analiza problema’, ‘Evropski Sud pravde proširuje pravila o pružanju usluga da pokriju migraciju’, ‘Olakšanja za pružitelje usluga radi legislative EU’, ‘GATS i migracije: sadašnjost i (neizvjesna) budućnost’, i u ‘Zaključku’.

NEW MIGRATION CONDITIONS IN THE EUROPEAN UNION AND LIBERALISATION OF TRADE IN SERVICES

SUMMARY

The primary goal of this paper is to illustrate the state of affairs in the European Union in terms of new migration opportunities and the liberalization of trade in services. In recent times the provision of services has taken over the role of being the fundamental lever for economic development and contribution, as opposed to the time when manufacturing represented this basis, hence an analysis of the state of migration opportunities caused by the liberalization of trade in services in the European Union was a logical choice for illustrating the ‘real’/current state of affairs. Through concrete examples, namely practical cases of the European Court of Justice, the positive and negative aspects of the case law of the European Court of Justice will be illuminated. The analysis was primarily guided by legal parameters that define this area of interest, thus followed by economic, political parameters et cetera. The results/conclusions were derived using analytical, deductive, observational, historical and comparative methods. Ultimately, the contribution to a higher degree of integration in the European Union, and therefore also in Bosnia and Herzegovina, as well as better and more liberal working conditions for the provision of services, as well as working conditions in general, are the ultimate motive for the creation of this paper. The aforementioned data will be presented in five chapters:’Analysis of the problem’, ‘Migration being covered by new, expanded, rules of the European Court of Justice’, ‘Benefits for service providers’, ‘GATS and Migration: The Present and the (uncertain) future’ and ‘Conclusion’.
